Terms and Conditions
Terms
BY PURCHASING FROM US, YOU AGREE TO THESE TERMS AND CONDITIONS. No other terms shall apply except as agreed in writing signed by us. We reserve the right to correct typographic errors and reject orders. All requests for additional documentation must be noted directly on the purchase order.
Freight Terms
All shipments Processed by W.J. Roberts will require one of the following (1) Shipping insurance (Declared Value) on collect shipments. (2) Declared Value for Prepay and Add shipments. (3) A current Freight Insurance Waiver on file with W.J. Roberts.
All shipments from W.J. Roberts are F.O.B Origin
Failure to insure or requesting "Do not declare value" will result in the customer being responsible for the full invoice amount in the result of the shipment being lost or damaged.
Prices; Payment
Prices, title and risk of loss are F.O.B. our warehouse. Prices don't include taxes or shipment and may be changed without notice. Payment due within 30 days of shipment, net on open account less 1% for payment within 10 days of shipment. Open accounts available on approval.
Returns
Manufactured to customer’s specifications or requiring special processing cannot be
returned for credit or cancelled after order entry. Materials that may be returned must have prior, authorization or they will not be accepted. All claims must be made within 30 days of invoice date. All returns will be subject to A charge of 25%
($30.00 minimum) for handling and restocking.
Limited Warranty
Our only warranty obligation is to replace any item proved defective in material or workmanship. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PURPOSE, ARE DISCLAIMED.
Liability
WE SHALL NOT BE LIABLE IN CONTRACT, WARRANTY, TORT OR OTHERWISE FOR CONSEQUENTIAL, SPECIAL, EXEMPLARY OR INCIDENTAL DAMAGES. IN NO EVENT SHALL OUR LIABILITY EXCEED THE PURCHASE PRICE. ENFORCING THE LIMITED REPLACEMENT RIGHTS IS YOUR EXCLUSIVE REMEDY.
Obligations
You warrant, represent and agree: (1) to comply with all laws; (2) that our sale and shipment of the product will not, by export thereof, your legal status or otherwise, cause us to violate any law; and (3) to indemnify us against any losses from a failure by you or a third party to comply with law or these terms and conditions, or from use of the product.

Standard commercial tolerances on material, all other dimensions are +/-.005 unless otherwise specified.
